The web pages on our site and all pages linked to it are the property of and operated by ATZ GIDA INSAAT TICARET VE SANAYI LIMITED SIRKETI at www.atzstil.com. You (‘User’) are deemed to have accepted that you are subject to the following terms while using all services offered on the site, and by benefiting from and continuing to use the services on the site; you have the right to sign contracts according to the laws applicable to you, you have the authority and legal capacity, and you are over 18 years old. You accept that you have read, understood, and are bound by the terms stated in this agreement.

This agreement imposes rights and obligations related to the site on the parties, and when the parties accept this agreement, they declare that they will fulfill the mentioned rights and obligations completely, accurately, on time, and in accordance with the conditions required in this agreement.

1. RESPONSIBILITIES

a. The company reserves the right to change prices and offered products and services at any time.

b. The company accepts and commits that the member will benefit from the services subject to the contract, except for technical malfunctions.

c. The user accepts in advance that they will not engage in reverse engineering or any other actions aimed at finding or obtaining the source code during the use of the site; otherwise, they will be responsible for any damages incurred regarding third parties, and legal and penal actions will be taken against them.

d. The user agrees not to produce or share content that violates general morality and decency, is illegal, infringes on the rights of third parties, is misleading, aggressive, obscene, pornographic, violates personality rights, infringes copyright, or promotes illegal activities in their activities on the site, in any part of the site, or in communications. Otherwise, they will be fully responsible for any damage that occurs, and in this case, the site authorities reserve the right to suspend or terminate such accounts and initiate legal processes. Therefore, they reserve the right to share information requests regarding activities or user accounts from judicial authorities.

e. The relationships of the site members with each other or third parties are their own responsibility.

2. Intellectual Property Rights

2.1. All intellectual property rights, whether registered or unregistered, including title, business name, trademark, patent, logo, design, information, and methods found on this site belong to the operator of the site and the owning company or the specified relevant party and are protected under national and international law. Visiting this site or benefiting from the services on this site does not grant any rights regarding these intellectual property rights.

2.2. The information on the site cannot be reproduced, published, copied, presented, and/or transferred in any way. The whole or part of the site cannot be used on another website without permission.

3. Confidential Information

3.1. The company will not disclose personal information transmitted by users via the site to third parties. This personal information includes any information aimed at identifying the User, such as their name, address, phone number, mobile phone number, and email address, and will be referred to as ‘Confidential Information.’

3.2. The user agrees and declares that they consent to the company that owns the site sharing their contact, portfolio status, and demographic information with its subsidiaries or affiliated companies, limited to promotional, advertising, campaign, promotion, announcement, etc., marketing activities. This personal information may be used to determine customer profiles, offer promotions and campaigns suitable for customer profiles, and conduct statistical studies.

3.3. Confidential Information may only be disclosed to official authorities when requested in accordance with due process, and in cases where disclosure is mandatory under applicable mandatory legislation.

THIS CONTRACTUAL PROVISION WILL BE VALID TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SERVICES PROVIDED BY THE COMPANY ARE OFFERED "AS IS" AND "AS AVAILABLE" AND DO NOT INCLUDE ANY EXPRESS OR IMPLIED WARRANTIES REGARDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS RELATING TO SERVICES OR APPLICATIONS (INCLUDING ALL INFORMATION CONTAINED THEREIN).

5. Registration and Security

The user is required to provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be deemed violated, and the account may be closed without informing the User.

The user is responsible for the security of passwords and accounts on the site and third-party sites. The company cannot be held liable for any data loss and security breaches that occur, or for any damage to hardware and devices.

6. Force Majeure

If obligations arising from the contract cannot be fulfilled by the parties due to reasons beyond their control, such as natural disasters, fires, explosions, civil wars, wars, riots, public movements, declaration of mobilization, strikes, lockouts, and epidemics, as well as infrastructure and internet failures and power outages (hereinafter referred to collectively as "Force Majeure"), the parties will not be liable for this. During this time, the rights and obligations arising from this Agreement will be suspended.

7. Integrity and Applicability of the Agreement

If any provision of this agreement becomes partially or completely invalid, the remaining provisions of the agreement will continue to be valid.

8. Changes to the Agreement

The company may change the services offered on the site and the terms of this agreement in whole or in part at any time. Changes will be effective from the date they are published on the site. It is the user’s responsibility to follow the changes. By continuing to benefit from the services offered, the user is deemed to have accepted these changes.

9. Notification

All notifications to be sent to the parties regarding this Agreement will be made via the known email address of the Company and the email address specified by the user in the membership form. The user accepts that the address specified when they register is a valid notification address and agrees to notify the other party in writing within 5 days if it changes; otherwise, notifications made to this address will be considered valid.

10. Evidence Agreement

In case of any disputes that may arise regarding transactions related to this agreement, the parties' books, records, and documents, as well as computer records and fax records, will be accepted as evidence in accordance with the Law on Civil Procedure No. 6100, and the user agrees not to object to these records.

11. Resolution of Disputes

The Istanbul (Central) Courts and Execution Offices are authorized to resolve any disputes arising from or relating to the application or interpretation of this Agreement.

This KVKK Information text primarily outlines, in accordance with the Law on the Protection of Personal Data No. 6698 ("KVKK");

1. What types of data are collected through the website www.atzstil.com, how your collected data is used, and with whom Atzstil can share your data.

2. Your rights regarding the data processed by Atzstil and how you can exercise those rights.

3. How you can change your preferences for receiving electronic commercial communication.

In order to provide better service to our Members; to manage, complete and ensure communication related to your order processes; to inform you about products, services, campaigns, and promotions; to better understand your shopping preferences, conduct trend analyses and statistical analyses, and to enhance the security of the Site, we process a number of your data, including but not limited to your name, surname, email address, phone number, gender, date of birth, T.C. identity number, tax identification number, personal interests, invoice and delivery addresses; as well as information shared through social media accounts if you connect via those channels, in accordance with our legal obligations arising from the Law on Regulation of Publications Made in the Internet Environment No. 5651, the Law on Regulation of Electronic Commerce No. 6563, the Turkish Penal Code No. 5237, the Law on the Protection of Personal Data No. 6698, and the secondary regulations of relevant laws.

In addition to this data, we also collect and process non-personal statistical data, such as the frequency and times of visits to the Site, order placement times, IP addresses at the time of order, and statistics of visited product pages and ordered products, for the purpose of analyzing and understanding visitor behavior and preferences.

We process these personal data for you to benefit from the services we provide on the Site, provided that there is explicit consent or that it is directly related to the establishment or execution of a contract with you, or in cases where processing the data is necessary for our legitimate interests, without infringing on your fundamental rights and freedoms, and in accordance with the purposes and scope determined by this KVKK Information, while taking appropriate data security measures.

We use some of the data collected in our database for periodic campaign work to be sent at certain intervals, for the design of special promotional activities aimed at customer profiles, and for customer classification efforts to prevent unwanted emails, in compliance with relevant legal regulations.

When you use a credit card to pay for a product, you accept that your credit card number, expiration date, CVV2 code, and similar information may be shared with banks. Additionally, credit card and/or bank card information used during the order creation process is never stored in our systems.

If you provide your contact information at our stores to create a customer record, your personal data may be collected verbally during your conversations with store staff. The personal data collected during customer registration processes may be used to verify your contact information; to create consumer behavior-based special campaigns and promotions with your explicit consent; to send you direct commercial electronic messages regarding our products and services for marketing purposes; and to facilitate the tracking and necessary records for your return and exchange processes.

Atzstil reserves the right to retain any records related to a terminated membership account, provided that they are anonymized. Once anonymized, the data loses its ability to identify a person and, in this sense, should not be considered personal data. The Member cannot make any claims regarding anonymized records.

We may share your personal data with third parties (such as cargo, shipping, call center, database service providers) with whom we collaborate to provide our services, and with public authorities as required by our legal obligations. Atzstil may share your personal data and navigation information related to your visit to the Site or membership with public institutions and organizations that are legally authorized to request this information for your security and to fulfill Atzstil’s legal obligations. However, we will not use your personal data for commercial purposes or share it with third parties outside of the aforementioned activities and as required by relevant legislation.

Atzstil is obligated to retain Member information that it is legally required to keep. Additionally, Members have the rights to be informed about their personal data, to access this data, to request corrections or deletions of this data, and to inquire about whether their data has been used for its intended purposes.

To the extent that your personal data is processed by Atzstil in its capacity as a data controller and in accordance with Article 11 of the KVKK, you can send a written request to the contact address on the contact page or email us at www.atzstil.com using the registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the email address you shared with us during your membership, to exercise your rights regarding your personal data:

1. To learn whether any of your personal data is being processed;

2. To request information regarding the processing activities of your personal data;

3. To learn the purposes of processing your personal data;

4. To know the third parties to whom your personal data has been transferred, both domestically and abroad;

5. To request correction of your personal data if it is incomplete or inaccurately processed;

6. To request the deletion or destruction of your personal data if the reasons requiring its processing no longer exist or if the Company no longer has a legal basis or legitimate interest to process the data;

7. To request the Company to ensure that third parties authorized by the Company and processing personal data respect your rights within this section;

8. To object to any negative consequences arising from the processing of your personal data through automated systems;

9. To claim compensation for damages in the event that you suffer a loss due to unlawful processing of your personal data.

You can always update your membership and communication preferences by logging into the system.

Atzstil undertakes to take necessary measures to prevent unauthorized access to personal data or loss, misuse, disclosure, alteration, or destruction of this information. It is committed to maintaining confidentiality, taking all necessary physical, technical, and administrative measures to ensure privacy and security, and exercising necessary care. Despite taking necessary information security measures, if personal data is damaged or accessed by third parties due to attacks on the Site and system, this situation will be immediately reported to you and the Personal Data Protection Board, and necessary precautions will be taken.

Atzstil may make changes to this KVKK Information at any time. These changes will take effect immediately upon the publication of the modified new provisions and/or policies on the Site. In such a case, necessary information will be provided to you, our members.

I consent to receive commercial electronic communications and other messages in accordance with the relevant laws, including the announcement of the products and services offered by Datagate Bilgisayar Malzemeleri Tic A.Ş. (“Datagate”), notifications of updates, celebratory messages, sharing of content such as presentations and newsletters, and advertising and promotions. I acknowledge that my contact information, identity information, and marketing information will be collected for the purposes of conducting sales and advertising/campaign/promotion processes. I understand that I will receive messages through my preferred communication channel, that I can change my communication preferences at any time, or that I can stop communication by rejecting the process specified in the messages I receive without providing any reason.
